MP fines company that promised to double investments in bitcoin

The Prosecutor’s Office of Rio Grande do Norte (MP-RN) has signed a non-criminal prosecution agreement with the owner of the company Bitcompras Serviços Digitais Eireli, which promised 100% profit from alleged investments in bitcoin.

The agreement was brokered by the 2nd Prosecutor’s Office of the Canguaretama District, with the support of the Special Action Group to Fight Organized Crime (GAECO). Detailed information about the procedure, effective on January 31, 2023, became public on March 2.

The leader of the company suspected of committing the fraud confessed facts befitting the crime of embezzlement established in a police investigation. According to what was agreed, he has committed to pay the monetary installment of one million reais, an amount divided into ten monthly installments, the first of which has already been paid.

The company Bitcompras Serviços Digitais Eireli was the subject of an investigation by the MPRN that began in 2018. According to the authority, several people report losses after investing in the company.

According to the MP, the company offered profits from bitcoin but in fact captured values ​​to commit crimes of the popular economy in Brazil.

When the deal was finalized, the MP agreed with the company to pay R$400,000 to public consumer protection agencies in the city of Canguaretama. Justice must decide which authorities receive the amounts.

In addition, another 600,000 reais will remain at the disposal of the judiciary for possible victims of the company. For this, those who had a contract with the fraudulent company must go to court to claim their rights.

The terms of the agreement concluded with Bitcompras were disclosed to all interested parties.

What is a Criminal Non-Prosecution Agreement?

The Criminal Non-Prosecution Agreement (ANPP) is an instrument provided for in Brazilian law that allows for the conclusion of an agreement between the prosecution and the person under investigation. This instrument is intended to close a criminal case without having to take the case to court.

The ANPP can only act on crimes without violence or serious threat to the person, with a maximum prison sentence of up to 4 years. For this, the investigated person must confess to having committed the crime and agree to comply with certain conditions, such as paying a fine or repairing the damage caused.

It is worth noting that the ANPP does not apply in cases of crimes committed with violence or grave threat to the person, heinous, against public administration, among others provided for by law. In addition, the decision to enter into the agreement rests solely with the MP, which in any case assesses the convenience and expediency of its use.

According to MP-RN, the prosecution has invested in this type of conflict resolution, streamlining criminal cases.
