Regulation for the protection of the rights of users of public services is being adapted

The expert commissioner of the Energy and Gas Regulation Commission (Creg), Natasha Avendaño, presented the update of the protection regime for the rights of users of public services at the XXVth Andesco Congress in Cartagena.

“The Commission is promoting this update on the basis of the powers that Law 142 of 1994 has given us. It is important to emphasize that for the Creg, the protection of users’ rights has always been a priority,” said the expert commissioner.

The new regulation aims to keep the user informed and empowered to make decisions; In addition, the standard will clearly define the procedures between the user and the service provider, allow the implementation of more tools that facilitate user claims and centralize their rights and obligations.

Among other things, it strives for simplicity and clarity, both in public service contracts and in the billing that reaches the end user; It also tends towards clear and simple procedures and availability of information, the latter of which will be the fundamental pillar of the new regime.

Avendaño said that as part of the construction of this proposal, he has conducted several studies that define and design communication mechanisms for users, analyze regulatory powers, assess other countries’ experience and look for components to strengthen and modernize the regulation of protection of user rights.

Likewise, it asked for suggestions and contributions from the agents according to the stages of the service; to the Superintendent of Home Public Services in the exercise of control and monitoring functions; to the Superintendence of Industry and Commerce taking into account the new regime; and the Bureau of Environment and Social Affairs of the Ministry of Mines and Energy, to look for a joint strategy to get input from users in different parts of the country.

The information is gathered in the Regulatory Impact Analysis document, which is available on the Creg website, www.creg.gov.co, for citizen comments. There, in addition, the background, diagnosis, identification of the problem, causes and consequences of updating this Regulation are presented, as well as objectives and alternatives that will be part of the final document.

The comments of the users of the public home services of energy, gas, fuels via pipe networks and LPG via cylinders will feed the regulations and will be a fundamental tool to ensure that the final resolution of the Creg meets the needs of all interested parties. .
