Major land-use reform signed by the President

President Andrzej Duda signed an amendment to regulations on planning and land development on Tuesday.

It is now possible to establish a new local plan within 8-9 months.

“This the Copernican Revolution in terms of plans. We simplify the regulations so that municipalities can quickly and efficiently establish general and local plans. No more clutter in the space of Polish cities and towns, no more uncontrolled proliferation of buildings and patho developers in places that are not suitable for this,” Waldemar Buda, Minister of Development and Technology, said in a press release.

The amendment introduces a new planning tool – a general plan, a document at the rank of a local law, which will be compulsorily adopted for the entire municipality. Municipalities have until 1 January 2026 to do so.

“The general plan will replace the current study of the conditions and directions of the spatial development of the municipality. It will be a document containing only the basic arrangements that will enable the municipality to plan sustainable and harmonious development. Importantly, the findings will form the basis not only for the approval of local plans, but also for making decisions on the construction conditions” – explained in the communiqué.

The Ministry of Development and Technology stressed that the overall plan will have digital form, solving the current problems that in the traditional, paper version of the study and development plans, the lines drawn therein, for example marking the boundaries between individual zones, are not so precise that they can be interpreted in relation to a square meter on the ground. The digital version allows you to freely enlarge the map so that it is much more accurate.

A new form of the local plan will be an integral investment plan drawn up at the request of the investor, which will eventually replace the previous one based on the so-called Special Housing Act. After signing an urban development agreement with the municipality, the investor may be obliged to build a school or support such an investment, for example. Most provisions of the signed act come into effect 30 days after the date of publication.
