There are only a few days left until the end of 2023, and with it, in addition to the December holidays, will come one of the employment benefits that Mexicans most look forward to in the final period of the year: bonus.
But if you don’t yet know what this benefit is, here we explain everything: what it is, when it is calculated and who can use this benefit.
In accordance with Article 87 of the Federal Labor Law, employees will be entitled to an annual bonus, which must be paid. until December 20.
Who is eligible for the bonus?
All employees, whether ordinary, trusted, permanent, unionized, hired on a project basis, for a specific time, season, for an indefinite period, subject to inspection or initial training, temporary workers, commission agents, commercial agents, insurance agents, salesmen and others similar.
In general terms, this work benefit applies to all people who offer their services under the supervision of an employer in accordance with the Federal Labor Law.
When should the bonus be delivered?
The bonus must be paid before December 20th.
What bonus should I receive?
You should get at least the equivalent 15 days daily basic salary or the usual amount you receive for a day worked.
How do I calculate my bonus?
Multiply your base salary or daily rate by 15.and you will receive the amount corresponding to your bonus.
For example:
If you earn P10,000 per month, you need to divide that amount by 30 to find out what your daily basic salary is P333.33 per day.
Now the daily basic salary is multiplied by 15, which is 4999.95 pesos.
Are employees who have worked for the company less than a year entitled to a bonus?
Employees who have not completed one year of work experience on the date of payment of the bonus or whose employment relationship ends before the date of payment of the bonus are entitled to receive a proportional part of it.
This calculation is based on the time they worked in the calendar year, regardless of the exact duration, even if they are employed by another company at the time of payment.
If an employee quits his job voluntarily, is he entitled to receive a bonus?
Employees who leave work before December 20 are entitled to receive a proportionate portion of the bonus corresponding to the time they worked.
A pro rata bonus must be paid upon termination of the employment relationship as part of liquidation or settlement.
Is it possible to write off part of the bonus payment?
No, with the exception of discounts established by the Federal Labor Law.
What should I do if I don’t receive my bonus by December 20th?
Federal Labor Law establishes the employer’s obligation to pay bonuses on time. In case of non-compliance, these violations are subject to penalties ranging from 50 to 500 times the UMA and the employee is given a period of one year to request payment.
