Most people can’t throw away that much money. “Those who neglect this type of insurance are often people with very little money,” says personal injury expert Rini Withagen.
“And you can’t get people’s benefits, even if they’re responsible for the damage. It’s a well-known saying, you can’t pluck a bald chicken.”
“Ask for insurance”
So if you have damage caused by someone without liability insurance — and that person can’t pay for the damage out of their own pocket — there’s not much you can do. “In the event of an accident with a motor vehicle, you can always contact the Motor Traffic Guarantee Fund and the Compensation Fund for violent crimes,” says Withagen. But are these questions not valid?
The injured party therefore bears the costs, but the impact can also be large for the liable party. If a judge determines that you, as the claimant, are responsible for the victim’s costs, your guilt may continue to haunt you.
Even if you don’t have the money, the judge’s decision can last up to 20 years. “Ten years later, for example, the injured party can still call on a bailiff if you have a higher income or savings,” explains Jordy Tschur of the Juridisch Loket.
