The bill, which could force municipalities to accept asylum seekers, is “unnecessarily complex” and raises “investigative questions” about its applicability. This is the State Council’s view on the so-called distribution law that the cabinet wants to introduce.
The new law provides that municipalities will be given a target for the number of asylum seekers they have to accept. You can then create a maintenance plan yourself.
If they submit these before May 1 and offer more than 100 places over the course of five years, they can receive bonuses. If the municipalities do not have a plan by May 1 and there is not enough space in the province, the cabinet can force the municipalities to do so.

According to the Council of State, the complexity lies in the fact that municipalities can initially offer places and then it must be decided within the state who will realize the other places. “This leads to uncertainty about the exact mission.”
In addition, the award procedure and bonuses contribute to the competition between municipalities, according to the council. The government strives for solidarity among the various municipalities.

Examining the legislation in terms of quality and applicability, the Council of State believes that much of the draft law is still unclear. For example, the deadline for the municipalities to provide shelter has not been determined, and how the distribution will be made between provinces and municipalities has not been determined.
“However, the distribution hits the core of the bill and cannot be edited later (…)”, the advisory board writes. The Council of State recommends changing the law and choosing a “simpler system”.

The distribution law came out with great difficulties and VVD in particular had to deal with it. The Central Office for Receiving Asylum Seekers and the Dutch Association of Municipalities had previously harshly criticized the proposal.
