Priorities in trials, detention in “deferred flagrante delicto”, refreshments and in terms of prevention, reinforcement of the institution of the warning on crimes of espionage and use of the electronic bracelet, with imprisonment in case of tampering, finally the distance of no less than 500 meters of places frequented by the victim. The government is implementing a new crackdown on gender violence, a true emergency that in six months causes the death of nearly 50 women. Here is the new package, with a bill in 15 articles, approved by the Council of Ministers, which is part of the Red Code. “Extremely restrictive” measures will be introduced, assured the Minister of Justice, Carlo Nordio. “We want to act in prevention, timing and training”, underlined the Minister of the Family, Birth rate and Equal Opportunities, Eugenia Roccella: “We reinforced the precautionary measures – electronic bracelet, distancing, warning and even arrest in flagrante delicto – and then We intervened at the time also because we had some convictions from the Court of Human Rights precisely on the delay with which the precautionary measures were decided to protect possible victims”. “All this is not enough if it is not accompanied by a cultural change – he added -. in the case of Giulia Tramontano, no law could save her”.
In particular, among the measures, priority is given to the handling of cases. The Public Prosecutor’s Office assesses, “without delay and in any case within thirty days of the entry of the person’s name in the register of criminal occurrences, the existence of conditions for the application of precautionary measures”, and the judge, for his part, time, then proceeds “by order to be adopted within a period of 30 days”. With regard to the use of the electronic wristband, the bill changes the code of criminal procedure: the expression “when verified its availability by the judicial police” is replaced by the expression “subject to verification of the relative technical viability by the judicial police” ; provision is made for preventive detention in the case of tampering. Deferred arrest in flagrante delicto was extended, within a period of forty-eight hours, if the fact unequivocally resulted from video or photographic documentation, for crimes of violation of expulsion orders, mistreatment against family members or cohabitants and persecution. Finally, a chapter on refreshments is foreseen, with a provisional provision for the victim or his heirs, in case of crimes committed by the partner or ex.
Meanwhile, the president of the Senate, Ignazio La Russa, relaunched his proposal for an all-male demonstration, which is “coral” and “non-partisan”, based on the assumption that “femicide is a problem that concerns men”. “A wonderful idea” also for Roccella.
