Government tightening security: New crimes and controversial news

Meloni’s government launched a new “security package”. The provision was approved by the Council of Ministers today, 16 November, and was described by Palazzo Chigi as “particularly important” with “numerous innovations”.

Greater protection is being introduced for law enforcement officers who are subjected to violence or injured, and a new crime is being created to punish those who participate in or organize riots in prisons. ‘Fast-track’ procedures for the liberation of properties were introduced to combat illegal occupations. The green light was also given to interventions against fraud against the elderly and special measures to combat pickpocketing and begging of minors.

The approval of the new package came just hours after Prime Minister Giorgia Meloni and competent ministers met with unions and representatives of defense, security and public rescue sector personnel. What’s included in the new security package?

Protections for law enforcement

If crimes of violence, threat or resistance against public officials are committed against public security or judicial law enforcement officers, aggravated punishment will be applied. In addition, the punishment is expected to be aggravated due to the damage caused to them. The penalty for those who deface movable or immovable property used by the police force or other public institutions is increased if the act is committed with the aim of damaging the reputation or good manners of the institution.

Law enforcement officers with “special” weapons

Public security officers who are authorized to carry firearms for service purposes may possess private firearms other than official firearms without the need for a license. It is a regulation that the industry has been eagerly awaiting, and which will, for example, allow officers to carry a lighter weapon when off-duty, instead of the standard weapon, which is usually much heavier.

New crime of rioting in prisons or CPRs

A new offense was introduced punishing those who organize or participate in a prison riot with acts of violence, threats or other dangerous behavior. Those who organize the rebellion will be sentenced to 2 to 8 years, and those who participate will be sentenced to 1 to 5 years. In case of use of weapons, there are special aggravating circumstances of up to ten years. Another type of crime is to punish those who incite rebellion by writing to prisoners, even if they are from outside the prison. The rule applies even if riots occur in CPRs.

Handcuffs against illegal professions

A new crime is being introduced that can be prosecuted upon the complaint of the attacker; It punishes a person who occupies or holds another person’s property without a title deed, by violence or threat, or in any case prevents the owner from returning to his old home, with a prison sentence of 2 to 7 years. property or the person who holds it. Two measures have been introduced to make this rule more effective. First: The ground of impunity is foreseen for the occupier who cooperates in revealing the facts and voluntarily releases the occupied property. Second: A special procedure is organized very quickly to release the property and return it to its rightful owners. Normally the judge deals with this, but in emergency situations where the occupied property is, for example, the injured person’s only home, there is a possibility that the release/return of the property will be carried out directly by the police forces. The person receiving the complaint, without prejudice to the subsequent verification intervention of the public prosecutor and the judge.

Fraud against the elderly

A crackdown on scams against the elderly and the most vulnerable is expected. The prison sentence for aggravated fraud is being increased from 2 to 6 years, and in this case, the police are also given the opportunity to continue arresting people red-handed.

Measures against pickpocketing and begging of minors

The police commissioner may order the prohibition of access to subways, railway stations and ports to persons previously reported or convicted of theft, extortion or other crimes committed against property or persons therein. In addition, in criminal proceedings regarding such crimes committed in the metro and other areas of public transportation, in cases where the law allows conditional suspension of the sentence, the judge must in any case foresee the prohibition of access to such places. Additionally, a rule was introduced to impose sanctions on those who employ minors as beggars. A special rule is being added to the already prescribed rules to punish those who organize or support this activity, which will penalize those who encourage a child under the age of 16 to beg instead of sending him to school or coerce him with violence or threats.

A more complex regime is envisaged in the execution of sentences for women who are sentenced while they are pregnant or have children under the age of three. Postponement of the execution of the sentence is no longer mandatory, but this option is preserved in the presence of legal obligations. Factors that may affect the judge’s evaluation will include, for example, recidivism. Later, the opportunity for detained mothers to serve their sentences in reduced detention institutions was provided, without prejudice to the prison ban for pregnant women and mothers of young children (up to one year old).
