Greater protection for the police, but not only that. The security package approved by the Council of Ministers contains an important repression also aimed at protecting fragile subjects, victims of fraud or usury, and against phenomena that – especially in recent times – have proliferated in cities, such as roadblocks or damage to cultural property for demonstration purposes. The Government therefore says yes to authorizing off-duty State Police agents to carry firearms without a license. The aggravation of the sentence is then introduced in cases where violence, threats or resistance are committed against public security or judicial police agents. With regard to combating disturbances that often occur in prisons, the crime that punishes anyone who organizes or participates in a riot in a penitentiary establishment has now been introduced. The sentence varies from 2 to 8 years for those who organize the revolt, and from 1 to 5 years for those who participate. There are also specific aggravating circumstances of up to 10 years, if the revolt occurs through the use of weapons. The most severe penalty, with a prison sentence of up to 6 years, will also be applied if riots occur in migrant reception facilities. The crime of possession of material for terrorist purposes is then introduced. This involves bringing forward the threshold of punishment for those who disclose or announce, even electronically, preparation material or use of explosives for crimes such as massacres, fires and much more.
In terms of illegal occupation of properties, a new crime was introduced that punishes anyone who, with violence or threats, occupies or detains someone else’s property without a title, or in any case prevents the owner from returning the property to a prison sentence of 2 to 7 years. or whoever owned it. In urgent cases, it is possible for the release/return of the property to be carried out directly by the police force that received the complaint. With regard to combating fraud committed against the elderly and the most vulnerable people, the prison sentence for aggravated fraud has now been increased from 2 to 6 years, with the possibility of the police carrying out arrests in the act. The police commissioner may instead order the prohibition of access to subways, railway stations and ports for anyone who has already been reported or convicted of theft, robbery or other crimes against property or people committed in these places. Another important change foreseen in the security package is that relating to the execution of sentences for pregnant prisoners or mothers. In effect, the postponement of the execution of the sentence for pregnant women or mothers of children up to 3 years of age will no longer be mandatory, but will become optional as long as the legal requirements are met. Finally, the Government’s bill also intervenes in the face of roadblocks, which especially in recent times have multiplied by environmental activists. The approved provision establishes that this case becomes a crime when it is particularly offensive and alarming, both due to the presence of more people and the fact that it was promoted and organized in advance.
