School and dimensioning, Valditara: “Satisfied with the Court’s decision”

The Constitutional Court took an important decision regarding the size of the school network in Italy, directly impacting regional competences in the field of education. The Regions of Tuscany, Emilia-Romagna and Puglia filed appeals against various provisions of law no. Decree-Law No. 197, of December 29, 2022, relating to the management of management staff in schools and the redefinition of autonomous educational institutions, in contrast to demographic decline. The Court rejected the appeals presented by the regions, establishing that, despite the existence of interference in competing regional competences in the field of education, the State’s competences prevail. The news was commented by the Minister of Education and Merit Giuseppe Valditara.

“We are aware of the decision of the Constitutional Court, anticipated by the statement from its Communications and Press Office, to reject the appeals filed by some regions against the reform of school sizing provided for by the PNRR. This is a decision that we, as a Ministry, have always believed in, aware of the well-founded reasons that we also expressed in our discussions with the regions themselves. While we await the reading of the reasons for the sentence, we hope that, once the reasons against the reform have disappeared, full and loyal collaboration can be resumed to carry out the process of implementing the dimensioning, which can no longer be postponed to allow for a start peaceful and timely next academic year”, said the minister.
