Mattarella: “I enacted laws that I did not agree with, but it is my duty”

“Several times I have enacted laws that I do not agree with, that I considered wrong and inappropriate, but they were voted on by Parliament and I have a duty to enact them, unless they are manifestly unconstitutional. promulgate, but they must be evident, a single doubt does not authorize me not to promulgate”. Sergio Mattarella spoke clearly. At the ceremony marking the 25th anniversary of the Permanent Observatory of Young Editors, the President of the Republic addressed hot topics and discussed the powers and role of the Head of State.

“The president promulgates laws and issues decrees, but he has rules that he must respect. Sometimes you hear that there has been an appeal to the Head of State not to sign a law because it is wrong, or if he signs it, it is said that he agrees. Both statements are wrong, it is as if we live with the Albertine statute which provided that the legislative power was entrusted to the two Houses and the king, who also had the sanctioning power to say ‘I do not agree with this law’. ‘Fortunately we are not in a monarchy, but we are a Republic and the Head of State has his limits”, said Mattarella.

And further: “The President of the Republic becomes particularly active when the system is blocked, when for any reason there is a blockage of the system, this can happen because not everything is predictable even in the constitutional provisions which therefore have an element of elasticity .”
