The White House on Tuesday criticized Texas’ new law allowing deportations without due process, saying it believes it “dehumanizes” migrants, but did not clarify whether the Joe Biden administration will sue the state to block the legislation.
At a news conference, White House spokeswoman Karine Jean-Pierre called the law “radical” and noted that it will not help keep the people of Texas safe near the border with Mexico.
According to Biden’s spokesperson, the legislation is sponsored by Texas Governor Greg Abbott, a Republican. It “profoundly demonizes” and “dehumanizes” migrants arriving in the United States.
“This is not what we should be as a country,” Jean-Pierre said, noting that the measure adds to a series of anti-immigration measures taken by Abbott, such as erecting razor wire at the border.
Questioned by the press, Biden’s spokesperson said it is not clear whether the administration will sue Texas over this law, as it has done on previous occasions, and said this is a decision for the Justice Department to make.
The American Civil Liberties Union (ACLU) of Texas and the Texas Civil Rights Project (TCRP) have filed a lawsuit against SB4, which gives police and state judges the power to arrest and deport immigrants without due process.
The bill preempts federal law because Texas judges would have the authority and, in some cases, obligation to order the deportation of a person regardless of whether they are entitled to asylum or other humanitarian protection.
