The workshop is maximato. We don’t know where Lopez Obrador is; What we do know is that he continues to dictate the most important national policy decisions in defiance of the Constitution, democracy, the judiciary, the separation of powers, autonomous bodies and the rights of citizens.
Andrés Manuel I was confirmed to be the lifelong owner of his party movement and the “fourth transformation”. On October 1, he left his post, but did not relinquish power. AMLO, Morena and 4T constitute an indivisible political entity.
In the last month of his reign, the demagogue radicalized his arbitrariness, abuse of power and contempt for the law. Worker authoritarianism is transsexual in nature and continues to grow.
Macuspano maximato is imposed with increasing coercive force, supported by the leadership of the chambers of deputies and senators, Morena and iron party discipline; as well as more than half of the current cabinet. The severity of the damage such oppressive delusions will cause may be irreversible.
The person who takes responsibility and the consequences of her predecessor’s delusions is President Claudia Sheinbaum Pardo. So far, Mexico’s first president has emerged only as a staunch defender of the toxic legacy of the workplace. We have not yet seen the government qualities he apparently possesses, nor his democratic vocation, nor his respect for the rule of law. This is a shame and poses a huge risk. Is there a cure for this?
The pact between Lopez Obrador and Claudia Sheinbaum was fair: appointing her as president in exchange for absolute loyalty. However, the difference between both characters is noticeable primarily in terms of experience and political acumen, as well as charisma and theatricality. On the other hand, the physician has better training, greater intellectual rigor, and superior administrative skills; although he has yet to demonstrate this potential.
When “This is Claudia” became a reality, the Tabasco fox was able to maintain unity within Morena and launched a strategy to ensure that the 4T continuity remained in his domain. He imposed Plan C as a government project and forced all of Morena’s elected legislators to sign a document in which they agreed to defend, without any changes, the 18 constitutional reforms contained in the plan.
Moreover, he surrounded her with his unconditional supporters in the Congress, in his party, in the cabinet and even in the inner circle of the President at the National Palace. Despite mutual affection, he was accustomed to imposing his will without any nuance; He doesn’t even trust his shadow.
“Either you are with me, or you are against me.” The instruments of control over his disciple were strengthened after the crushing victory on July 2 after September 1; and also, treacherously, with the inauguration of Claudia Sheinbaum as constitutional president of the United Mexican States.
Extortion is the main tool for restoring their dominance. It’s fenced.
However, Dr. Sheinbaum took office with the greatest institutional power in three decades; with very few counterweights. The democratic legitimacy gained through the elections (with “a little help” from his mentor) as well as the authority of his investiture would have made unnecessary the illegal, offensive and untidy manner in which over-representation was obtained; and the rushed and thoughtless approval of judicial reform that is misguided, costly, and electorally unfeasible.
The most prominent lawyers in Mexico and the world have demonstrated that Obrador’s unsavory judicial reform was not aimed at ending corruption in the sector or improving the administration of justice, but rather at controlling the judiciary. This was the result of whim and revenge, arising from the megalomania of the autocrat (Amicus Curiae document).
“The best is the worst that awaits him,” warned the main leader of the authoritarian regression. In fact, upon realizing that the Supreme Court did have the power to invalidate the Judiciary and National Guard reforms, it became even more radical and untimely introduced other constitutional reforms to prevent any challenge to any retroactive constitutional reform.
This unprecedented and grotesque attempt to strangle the judiciary and thereby kill the present constitutional democracy was called “constitutional supremacy”.
On the evening of Tuesday, October 22, in the Senate, Adan Augusto Lopez announced an initiative regarding the “indisputability of additions or reforms to the federal constitution.” The aim is to declare claims against changes to the Magna Carta inadmissible, “to avoid arbitrariness and discretionary use of the judiciary.”
This radicalization of the absurd was secretly planned by the Adan-Noronha-Montreal gang under the leadership of a leader operating in the shadows from an unknown location. It is mentioned that the secret meeting of the evil trinity was also attended by President Morena and “Andy”, the pride of the Obrador cronyism.
All indications are that President Sheinbaum was not previously consulted or informed about this initiative; The decision was made behind his back. This would mean a serious cover-up and even betrayal of the agreement of trust and respect between the former President and the President, which could be a turning point in the relationship between both characters.
The original draft of the decree included reforms and additions to articles one, 103, 105 and 107 of the Constitution. However, on the morning of last Wednesday, the 23rd, Adam Augustus had to back down and repeal the reform of the first article; of course, at the request of Claudia Sheinbaum, who, when asked in the morning, commented that the reform of the first constitution had been canceled.
Despite this, the reforms of the remaining articles have already been approved in the Senate, and the skating rink in the Chamber of Deputies is about to do so. Constitutional reforms approved by Congress could no longer be challenged or amended through amparo, constitutional controversy, or actions to declare unconstitutional.
The tyranny of the Morenoist majority could reform the constitution at will, without any restrictions and without the possibility of challenging it. Thus, these were articles against the progressiveness of human rights, individual guarantees, the inviolability of normative principles, the abolition of the independence of autonomous bodies, informal preventive detention, and even Article 83, which prohibited the re-election of the president of the republic.
It is despicable and intolerable that the arbitrariness and outrage of one man, who is no longer president, can create a constitutional crisis and political chaos in a country like Mexico; a nation with strong democratic institutions in the process of consolidation, the fourteenth largest economy in the world (IMF), and a trading partner of the United States and Canada.
Yesterday, Monday the 29th, Minister Juan Luis González Alcántara presented a draft resolution in which he proposes to elect by vote the ministers of the Supreme Court, the judges of the Disciplinary Court and the judges of the Superior Chamber of the Electoral Tribunal of the Judiciary of the Federation. ; but not to elect county judges or district magistrates by ballot.
Without any modesty, the chairman of the Political Coordination Council of the Chamber of Deputies, Ricardo Monreal, assured that the resolution would not be implemented if it was approved by the Supreme Court. President Sheinbaum commented: “The Ministers of the Court know that what they are doing is unconstitutional… They do not have the power of the Court to legislate or overrule constitutional reform…” (X/29/24).
It would be desirable that space be opened for common sense and reconciliation to avoid a train wreck that could cause a national catastrophe. Let us recall that among the powers and duties of the President, Article 89 of the Constitution establishes the duty: “To provide the judiciary with the assistance it needs for the prompt implementation of its functions.”
Overcoming a charismatic leader is a difficult task. Following Max Weber, President Sheinbaum is advised not to replicate her mentor’s method of government, but to exercise the “legal-rational power” appropriate to her assumption of office. Be guided by an “ethic of responsibility,” defined by the German sociologist as the ability to “weigh the consequences that political decisions and actions may have” through a sense of proportion determined by prudence.
The statesman is distinguished by “his ability to allow reality to influence his decisions through reflection and inner calm,” says Weber, adding: “Politics is made by the brain and not by any other part of the body or soul.” A matter of time and will or a lost cause?
Without an autocrat there is no autocracy, but there can be democracy (Rosanvallon).
The workshop is a maxima that leads into the abyss.
