The Spanish House of Representatives has passed a bill requiring explicit consent for sex. All other cases are in principle considered rape.
The vast majority of parliamentarians voted in favor of the left-wing government’s law known as “just yes, yes”. Only lawmakers from the conservative People’s Party (Partido Popular) and the far-right Vox voted against. The Senate has yet to confirm it, but this is considered a formality.
Under the new law, sexual abuse and assault are considered rape in all circumstances and are punishable by up to 15 years in prison. In addition, it is illegal to distribute “intimidating” compliments and obscene videos. Currently, Spanish law prohibits rape if the perpetrator uses intimidation or violence.

According to Equality Minister Montero, this is “a decisive step towards changing the sexual culture in Spain” and the end of “sexual terror” and “rape culture”. The feminist movement is making history,” she said.
The new law came after high-profile cases of gang rape in Spain. A lawsuit in July 2016 sparked outrage. In Pamplona, five men who forced an 18-year-old woman into prolonged sexual intercourse have been acquitted of rape. They were only punished for sexual abuse. The decision sparked massive protests in Spanish cities.
