Elon Musk's X Corp and xAI said Monday that they have resolved the antitrust lawsuit they filed against Apple in a federal court in Texas, in which they accused the iPhone maker of conspiring to illegally monopolize the smartphone and generative artificial intelligence chatbot markets.
In a court filing, X and xAI asked the court to dismiss the case, which they had brought against Apple last year. The filing did not explain why the companies sought dismissal, and it did not say whether a settlement had been reached.
The lawsuit had alleged that Apple violated antitrust law by exclusively integrating OpenAI's ChatGPT into Apple Intelligence, the artificial intelligence features built into iPhones and other Apple devices. It also accused Apple of illegally shutting out competitors through its partnership with OpenAI.
Claim against OpenAI continues
X and xAI said they would keep pursuing their claim against OpenAI, the maker of ChatGPT, which is also named as a defendant in the case.
Representatives for Musk's companies, for Apple and for OpenAI did not immediately respond to requests for comment, according to Reuters, which first reported the filing. The Reuters report was written by Mike Scarcella in Washington.
The companies behind the case
X Corp is the social media platform formerly known as Twitter, which Musk bought in 2022. xAI is his artificial intelligence company, known for developing the chatbot Grok. Apple Intelligence is the set of AI features Apple has rolled out across iPhones, iPads and Mac computers, with ChatGPT offered as an option for tasks Apple's own systems cannot handle.
The original lawsuit, filed last year, named both Apple and OpenAI as defendants over their partnership to bring ChatGPT to Apple devices. With the case against Apple now dropped, the dispute over that partnership will continue to play out in X and xAI's ongoing claim against OpenAI alone.
