Spanish labor lawyer Sebastián Ramírez has clarified that accidents occurring while commuting to or from work retain full legal protection under Spanish labor law.

Ramírez explained through his LeyesConSebas TikTok account that an in itinere accident is treated in the same manner as an incident occurring directly inside the workplace. The legal protection covers travel between a worker's habitual residence and their place of employment, provided the journey maintains its primary work purpose.



Under Article 156 of Spain's General Law of Social Security, published in the Official State Gazette, recognized commute accidents can activate immediate coverage. This includes economic benefits from the first day, provided through Social Security and mutual insurance entities.

Legal definition of in itinere accidents

Spanish legislation defines an in itinere accident as any injury suffered by a worker while traveling to or returning from their workplace. The Latin term in itinere refers to events taking place during a journey, and the legal framework protects the commute in both directions.

Legal classification does not depend solely on the chosen mode of transport. Walking, cycling, using public transport, or driving a private car are all covered under the same framework. Authorities evaluate whether the travel route was reasonable and aligned with the worker's scheduled shift hours.

To establish that a travel incident qualifies as a workplace accident, investigators examine the starting point, final destination, total time elapsed, and specific route taken. Following the habitual route provides essential evidence that the journey was directly linked to employment.

Documentation required for commute claims

Workers involved in a commuting accident are advised to gather comprehensive documentation immediately after the event. Essential evidence includes official medical reports, police accident reports, witness contact details, public transport tickets, and records of working hours.

Employees should notify their employer as quickly as possible and request that the event be processed as a professional contingency. Written documentation is crucial to support the worker's account if questions arise regarding the exact itinerary or the time of the incident.

When Social Security or a mutual insurance company rejects the workplace classification, the affected worker can dispute the decision through established legal channels. Any formal claim must rely on verifiable physical facts rather than general explanations.

Factors that break the legal connection

The legal protection of a commute can be severed if the journey is interrupted or altered for personal reasons. Making personal stops, changing direction for non-work activities, or delaying travel for an extended period may break the link to employment.

Evaluating deviations requires analyzing the complete context of the trip rather than applying automatic rules. Distance alone does not determine the outcome, provided the home address, work site, and travel times fit the reported itinerary. Severe injuries from such accidents may also qualify workers to pursue permanent work disability benefits.

Recent court compensation rulings

The clarification comes alongside other recent Spanish employment rulings highlighted in labor claims. In one case, a carpenter whose hand phalanx was amputated secured total compensation of 237,822 euros following a workplace accident claim.

In a separate ruling, a court ordered a company to pay 6,251 euros in compensation to a father after the employer unjustifiably denied his request for a shift change to care for his daughter.
