The National Council of Justice decided on Tuesday to apply a 60-day availability sanction to appellate judges Carlos Eduardo Thompson and Loraci Flores de Lima. Both magistrates serve at the Federal Regional Court of the 4th Region.
The period of precautionary suspension already served by the magistrates will be deducted from the punishment. Because both remained suspended for more than 60 days, the sanction was considered fully served.
The case rapporteur, council member Rodrigo Badaró, defended applying the 60-day availability sanction with the deduction of the precautionary suspension period already served. Availability is a disciplinary sanction that temporarily removes a magistrate from duties, with remuneration proportional to service time.
Supreme Federal Court Violations
Both judges were investigated in an administrative disciplinary proceeding for allegedly failing to comply with Supreme Federal Court determinations related to Operation Lava Jato cases. According to investigations, they allegedly continued judging cases and issuing rulings after the Supreme Federal Court ordered those actions suspended, and based decisions on evidence already deemed invalid by the court.

Regarding federal judge Danilo Pereira Júnior, who was also investigated in the same proceeding, the National Council of Justice decided to archive the administrative disciplinary proceeding without applying any punishment. Danilo Pereira Júnior served at the 13th Federal Court of Curitiba, which was responsible for Operation Lava Jato cases in the first instance.
