Peruvian Senator Ruth Luque has filed a constitutional complaint against seven members of the National Board of Justice, accusing them of using disciplinary sanctions to pressure judges and prosecutors in Peru.
Luque is requesting that Congress declare the filing admissible, issue a formal constitutional charge, and remove all seven members from office while banning them from holding public positions.

According to the document, the National Board of Justice, known as the JNJ, allegedly misused its disciplinary powers to punish magistrates who were exercising their duties with autonomy.
The JNJ is the independent constitutional body responsible for appointing, evaluating, and disciplining judges and prosecutors across Peru. Constitutional complaints filed against high-ranking officials are processed through the Subcommittee on Constitutional Accusations in the Peruvian Congress.
Luque invoked Article 99 of the Peruvian Constitution alongside Article 174 of the Standing Rules of Congress to support her complaint.
The filing targets JNJ members Gino Ríos Patio, María Teresa Cabrera Vega, Víctor Chanduví Cornejo, Germán Serkovic González, Cayo César Galindo Sandoval, Jaime Pedro De la Puente Parodi, and Rafael Ruiz Hidalgo.
Constitutional violations and legal claims
The complaint details up to five distinct facts or events for each of the seven accused members. Luque asserts that the officials repeatedly violated constitutional principles governing public service and judicial independence.
Specific constitutional articles cited in the filing include Article 39, Article 139 paragraphs 2 and 3, Article 146 paragraphs 1 and 3, Article 158, and Article 159. These provisions establish standards for public administration, guarantee judicial autonomy, and outline the duties of prosecutors.
Annexed rulings and judicial concerns
To support her allegations, Luque attached several official JNJ resolutions as evidence of improper disciplinary actions. Among them is Resolution N° 019-2026-PLENO-JNJ, which ordered the dismissal of Delia Milagros Espinoza Valenzuela from her posts as supreme prosecutor and Attorney General of Peru.
The filing also cites Resolution N° 333-2026-JNJ, which opened a preliminary investigation against Judge Jorge Luis Chávez Tamariz of the Seventh National Preparatory Investigation Court of the Specialised National Superior Court of Judicial Criminal Justice.
Additionally, the complaint lists Resolution N° 151-2026-JNJ, which ruled not to ratify Oswaldo Alberto Ordóñez Alcánto as a judge on the Superior Court of Justice of Lima.
Luque further included an official statement issued on August 11, 2026, by the presidents of Peru's Superior Courts of Justice. According to the complaint, that statement demonstrates widespread concern within the judiciary regarding the recent decisions of the JNJ.
